1. General Terms and Conditions

1.1 The following Terms and Conditions are valid between you and Tremici. We as the brand Tremici are registered at the Chamber Of Commerce. COC number: 65601483 and VAT number: NL856180737B01.

1.2 Tremici cannot guarantee that all Tre-items that present in the Online Boutique are in stock or available for purchase. Orders can only be placed by people that are eighteen (18) years or older or have the authority of their parents to place an order. If you order a Tre-item / Tre-items in the Online Boutique you automatically agree to our Terms and Conditions. Therefore please read the Terms & Conditions before purchasing a Tre-item.

1.3 By Tre-item(s) we mean: Tremici item or Tremici items, all products on the Tremici Online Boutique are Tre-items.  

1.4 By Online Boutique we mean: the website of Tremici.

1.5 You should print a copy of these Terms and Conditions or save them to your computer or other devices for future reference.

1.6 Tremici respects and takes personal data seriously as private and confidential information and will never share this with any outside affiliations or individuals. We use Secure Sockets Layer (SSL) encrypted software to secure your information.

1.7 If you find an error or omission at the Online Boutique, please e-mail us directly at info@tremici.com.  

1.8 Tremici may terminate your access or use of this Online Boutique at any time, for any reason, if the user violates the terms & conditions. We also may terminate or revise the Terms and Conditions at any time. The users are responsible for updating themselves with any changes in regards to our Terms & Conditions.

 

2. Placing order

2.1 By using the Online Boutique and placing an order in the Online Boutique, by smartphone, tablet, personal computer (or other smart devices) you confirm that you have read the Terms and Conditions.

2.2 When you are using the Online Boutique, you also confirm the Privacy Policy and that you accept them both. You do not have the right to place an order if you do not accept the Terms & Conditions.

2.3 We do not save any Tre-item(s) added to your cart, meaning that you might want to order a product that is limited in stock, but someone else bought it before you did. If this happens, we are not responsible for this missed chance.

2.4 Please note that we cannot guarantee that all the ordered Tre-items are available in the warehouse at all times.

2.5 Tremici reserves its right to stop selling Tre-items if we encounter difficult situations that ask for this matter.

 

3. Order confirmation acceptance and shipping confirmation

3.1 After submitting your order, you receive an order confirmation e-mail. You will find relevant information in this e-mail about your ordered Tre-item(s): order number(s), which Tre-item(s) you have ordered, payment details and your delivery details. The confirmation e-mail is an acknowledgment that we have received your order.
Please note: the confirmation e-mail is not an e-mail that informs you that your order has been accepted.

3.2 After the confirmation e-mail we will send you another e-mail with the invoice.

3.3 The e-mail with the invoice is important and should be saved on your device. You are responsible for the loss of the invoice of your purchased Tre-item(s).

3.4 If you want to return a Tre-item(s) you have to show the invoice of your Tre-item(s). Tremici does not accept returns without the invoice.

3.5 In case a Tre-item(s) is unavailable, we will contact you by e-mail.  

 

4. Colors

Tremici does its best to describe the Tre-items in the Online Boutique. However, the color that you see on your screen might be different. We cannot guarantee that your monitor gives an accurate representation of the Tre-item. The colors of the Tre-items shown in the Online Boutique can differ somewhat from their actual colors. Tremici cannot be held responsible for any consequences arising.

 

5. Price

5.1 All the prices in the Online Boutique are shown in Euros (€).

5.2 VAT is already included in the prices of all the Tre-items. VAT is a value-added tax that both European Union (EU) and non-European Union (non-EU) customers pay. The prices and delivery costs are shown in the Online Boutique, it is possible that there are additional costs for non-EU customers. Tremici cannot be held responsible for any additional costs (import duties and taxes); however, you will be responsible for payment of any additional costs. The additional costs will not be reimbursed by Tremici.

5.3 We use Secure Socket Layer (SSL) which is a protocol for secure data transmission over the internet.

5.4 Tremici must receive the full payment of the prices of the Tre-item(s) before we can accept any orders.

5.5 Please also note that Tremici can cancel your order if we note that the prices of the Tre-item(s) are not correct!

 

6. Payments

6.1 Tremici accepts the following payment methods: Credit Card (Master card, Maestro, Visa and American Express), Paypal, iDeal and Bank transfer.

6.2 Credit Card/ Paypal/ iDeal or Bank transfer payment options in the Online Boutique are processed using Mollie.

6.3 When selecting the PayPal option, you will be redirected to the PayPal site to “Log In” and review the amount shown before clicking “Pay Now”. Once this transaction is complete, you will then return to the Online Boutique.

6.4 Please note when you have chosen for Klarna payment your shipping address needs to be your registered residence.

6.5 We do our best to make the Online Boutique as secure as possible.

 

7. Delivery

7.1 We offer free shipping to European (EU) customers. We offer ‘free’ shipping to non-European (non-EU) as well, but additional import duties and taxes may apply. Tremici cannot be held responsible for any additional costs (import duties and taxes); however, you will be responsible for payment of any additional costs.

7.2 Dispatch of orders may take up to five (5) business days, but we aim to dispatch the order within two (2) business days.

7.3 All orders are traceable, when you place an order we will send an automatic e-mail with a link to trace your Tre-item(s).

7.4 Shipping to outside of Europe Union can take up to two (2) weeks. But the customs can apply clearance time for international orders, it depends from one (1) till four (4) weeks.  

7.5 Tremici is not responsible for any lost, stolen or damaged shipments.

 

8. Right of Returns

8.1 For any reason, customers can return their Tre-item(s). Tremici accepts returns within fourteen (14) days from the delivery date.

8.2 You have the right to open the package and check the Tre-item(s) but the Tre-item(s) must be returned unused and unwashed. Returned Tre-item(s) must be in their original condition. We accept returns only if all the packaging is included (Tremici box, garments tags [still attached on the clothing], cardboard, and receipt holder). By “included” we mean: in a good condition without damages. Please be very careful when trying Tre-item(s) on, for example, ensure you are not wearing makeup, perfume, deodorant or antiperspirant, this may leave marks on the Tre-item(s) and we will not be able to arrange a refund for any Tre-item(s) returned to us with any marks or stains. The returned Tre-item(s) (included all the accessories: Tremici box, garments tags [still attached on the clothing], cardboard, and receipt holder) will be inspected and the return shall be processed within five (5) business days. We will contact you once the process is complete.

8.3 Customers are required to send the invoice with the returned product.

8.4 Tremici reserves the right to reject the return that does not meet the requirement specified in Article 8.3.

8.5 Refunds will be issued to the same payment account used at the time of purchase.

8.6 Tre-item(s) that have been personalized cannot be returned.

8.7 Shipping costs will not be refunded unless there was a mistake in delivery caused by us.

8.8 Tremici will not be responsible or liable if the Tre-item(s) you return is lost or misdirected.

8.9 To return the Tre-item(s), customers must follow the steps that are described through e-mail.

 

9. Design

All the product designs are made by Tremici. The Online Boutique and the 3D concept are made by Tremici.

 

10. Copyright

10.1 All images, illustrations, icons, designs, iconic statements (iconic triangle), photographs, video clips, written text, Terms and Conditions, Privacy Policy, script, software and the 3D-boutique that are part of this Online Boutique are protected by copyright, all worldwide rights are owned by Tremici. Do not copy the concept of the 3D Experience at the Online Boutique without Tremici’s prior written consent. You are also not authorized to use this 3D concept for personal, non-commercial purposes.

10.2 Use of all these materials (shown specified in Article 10.1) from our Online Boutique without Tremici’s prior written consent is strictly prohibited. Tremici reserves the right to take legal action if any use of these materials is used without direct consent from Tremici.

12. Cookies

12.1 Cookies are used in the Online Boutique to improve your browsing experience. In addition, to use for statistical purposes, cookies identify your computer (or other smart devices) and allows the Online Boutique to recall your personal settings.

12.2 Your internet browser can be set to send a notification when a cookie is activated. This allows you to deny use of this cookie or to delete the cookie at the end of your visit. The Online Boutique cannot be accessed if cookies are disabled.

 

13. Security

Tremici uses Secure Sockets Layer (SSL) which is a protocol for secure data transmission over the internet. A protocol is a set of rules and procedures on how information (data) should be treated. SSL protocol processes the data through an encryption process. This is done to make the data unreadable during transmission between the two computers. When data is received by the recipient SSL “puts together” the data in its original order, and checks so that the sender is correct and verifies that the data has not been altered in transit.

 

14. Links

14.1 We cannot be held liable for links to other websites at the Online Boutique. These websites are beyond our reach.

14.2 Websites specified in Article 14.1 do not have the same privacy policies that Tremici uses. Be careful when you use these sites.

14.3 Tremici cannot be held responsible for the use of these websites specified in Article 14.1

 

15. Violation of rules

Tremici reserves the right to seek all solutions available at law and in equity for violations of these Terms and Conditions. Tremici also reserves the right to block access to the Online Boutique.

 

16. Liability

16.1 The Tremici Online Boutique shall in no event be liable to the customer for any indirect or direct loss or damage arising out of or in connection with the ‘Agreement’, the sale of any Tre-item(s) by Tremici’s Online Boutique even if Tremici advised the Customer, death or personal injury caused by our negligence, to property of third parties, fraud, fraudulent misrepresentation the use thereof by the customer, whether or not such damage is based on tort, liability which cannot be limited by law, guarantee, statutory duty or otherwise, unless the damage is caused by Tremici.

16.2 If it is established that Tremici could be held liable for any damage, liability is capped and Tremici will only pay the price of the purchased Tre-item(s).

16.3 Tremici is not liable for the non-availability of the Online Boutique (www.tremici.com) or for technical or electronic errors in the Online Boutique.

 

17. Governing Law

These General Terms and Conditions and any Agreement shall be construed in accordance with the laws of the Netherlands, without regard to any conflict of law provisions.

19. Complaints

19.1 Tremici wishes to point out that the customer can rely upon the legal guarantee of conformity of goods. The customer is obliged to closely examine the delivered Tre-item(s) upon the day on which the customer acquires physical possession of the Tre-item(s).

19.2 The customer shall inform Tremici of any complaints about a defect and/or non-compliance with the specifications of the delivered Tre-item(s), including but not limited to complaints in respect of visible defects and/or damages of the Tre-item(s) and/or the color of the Tre-item(s).

19.3 All the complaints shall be sent to our customer support ([email protected]).  The e-mail shall contain a clear description of the complaint, a clear picture demonstrating the defect of the Tre-item, the name of the customer and the order number of your purchased Tre-item(s).

19.4 It is only possible to send us an e-mail of your defect Tre-item(s) within fourteen (14) days after receiving the product.

19.5 Complaints submitted to Tremici will be attended in less than five (5) business days. If this does not happen please contact us immediately with as subject: ‘Urgent’ at [email protected]  

19.6 Tremici can ask you to send photos or other evidence of your ‘defect’ Tre-item(s) to our customer support team.

19.7 In the event of a timely, correct and justified complaint the customer shall be entitled to either replacement or repair of the defective or non-conforming Tre-item(s).

19.8 A complaint that does not meet the requirements shall not be adopted by Tremici, the Tre-item(s) shall be deemed to have no defects and conform to the specifications and does not release the customer from any of its obligations under the Agreement.

 

20. Force majeure

20.1 Tremici shall not be liable for any failure or delay in performance if such failure or delay results from interruptions in the Tre-item(s) manufacturing process or if such failure or delay is caused by force majeure as referred, whether or not such force majeure was foreseeable at the time of the Agreement.

20.2 As a result of such force majeure and/or default by one of Tremici’s suppliers, Tremici cannot be required to execute its obligation. The customer shall not be entitled to any compensation whatsoever.

20.3 In the event that the force majeure and/or default by one of Tremici’s suppliers extends or reasonably expected by Tremici to extend for a period of three (3) consecutive months, Tremici shall be entitled to cancel the affected Agreement without any liability towards the customer.

20.4 The Buyer is not entitled to cancel the agreement due to force majeure within three (3) consecutive months.

 

21. These Terms and Conditions

The latest update of the Terms and Conditions of Tremici was made on February 28, 2018.
